In addition, in order to qualify, you must live in the United States or its territories. The amount of the fund for this case is $9 million. The plaintiffs in this case will get $30,000. The reason they filed the lawsuit is because the company kept and provided information of its customers. This information includes information on the movies and TV shows that the customers viewed. This is a violation of the Video Privacy Protection Act or VPPA. It is also a violation of the California’s Unfair Competition Law or UCL and California’s Customer Records Act or CCRA.
You have the right to ask to be excluded from the Netflix Video Privacy Class Action Lawsuit Settlement. You also have the right to remain in the class action but object to the case. In addition you have the right to do nothing in the case. When you do nothing, you will not get any compensation but you will remain a class member. This means that you will have given up all your legal rights if you do nothing. The deadlines for some of these legal actions can be found at the settlement website at www.VideoPrivacyClass.com. The deadline to exclude yourself is November 14, 2012. The deadline to object is also November 14, 2012. The Fairness Hearing will be held on December 5, 2012.
If you decide that you want to ask to be excluded from this case, you must provide some information in writing. You must have your name, your address, your phone number and your signature. You must also provide a statement that says that you are requesting to be excluded. You also must mention the name of the lawsuit which is In re Netflix Privacy Litigation. If you do not have this information, you exclusion request will not be processed. So this means that you will remain a Class Member and hence will not be able to sue the company or even take part in other lawsuits against the company. So make sure that you are careful when you provide the information in your exclusion letter. The address you need to send it to can be found on the website. Make sure that you send it to the correct address. If you send it to the wrong address, you will not be excluded.
Even thought the settlement amount is $9 million, you will not get any money even though you are a class member. I know this is terrible especially since your information was kept. It is a violation of privacy but you will not be compensated for this. Instead the company will use the money to make donations. The donations go to non-profit organizations. I think this is terrible indeed. Why not give the class members the money? Maybe there are too many people who may be eligible? I do not know the answer to this and am shocked that you as a class member will not get anything.
Usually I think that it is a good idea to take part in these settlements. However, in this case, I think you should exclude yourself. The reason for this is so that you can take part in other settlements against the company. After all you are not getting anything from this one. Only the Plaintiff get some money. The plaintiffs are those people who filed the initial lawsuit agains the company. So if you are not one of them, then you do not get anything. However the class counsel will be paid from the settlement fund. It is amazing how the lawyers always get paid.
You can appeal the judgement though. Basically you have 30 days from when the judgement is entered for you to appeal. An appeal process may help but it may also take a very long time. So even if you are successful in your appeal, you do not know how long it will take. It can take years so do think carefully before you decide to do this. There is no point in hiring your own attorney because you will have to pay the attorneys fees yourself. The Class Counsel who have been appointed by the Judge and paid from the fund can help you with any questions that you may have.
