There were lawsuits against the Nissan Pathfinder, Xterra and Frontier 2005 – 2010 models. The reason for the lawsuits is that the vehicles had defects. These defects allowed for the cross-contamination of the coolant and transmission fluids. This there caused the radiator and the transmission to fail. The people who bought the vehicles were not told by Nissan of the defects. Hence the Plaintiffs filed a lawsuit for breach of express warranty. The also said that the company breached implied warranty and was negligence. Charges of unjust enrichment and negligence were also brought against them. Of course there were also charges fo design defect and manufacture defect. In addition the other charges include assembly defect, fraud and violation of consumer protection statutes of a number of states.

If you have repaired the vehicle because of this defect, then you will be reimbursed for the amount that you paid. There are two types or reimbursements. The first is the reimbursement for previous repair. The second is the reimbursement for authorized repair. Each is different. There are some limitations that you will need to be aware of. Depending on these limitations, you will get a refund that fits the condition of the car or the number of mileage. Whatever the case may be, you must submit a claim form in order to get it. The final fairness hearing will be held on March 14, 2013. This is the time that the court will decide whether approve the settlement. If you would like to attend and voice your opinions, then you will have to request that in writing. It is good to let the court  know of your objections or your dissatisfactions because you want the company to pay for making you buy defective cars. If you had known of the issues, you would of course not buy the vehicles. However be careful about what you are objecting to. You are not objecting to the settlement because you want the company to pay. What you are objecting to could be the terms of the settlement or that the company is not paying you enough for what you suffered.

If you think that Nissan did nothing wrong (gasp!) then you can of course exclude yourself from the Nissan Radiator Class Action Lawsuit Settlement. I do not know why you would think that but if you decide to do this, you must write the court. You must provide the information that is needed to secure your exclusion. Otherwise you would not be excluded and you would not be able to sue yourself. That is the main reason many submit their letter to request exclusion. After all, who in their right mind would give up getting compensation?

As always, if you do not want to do anything, then you automatically stay in the settlement as a class member. This would be the worst place for you to be. This basically means that you give up all your rights. You do not get the compensation and you cannot sue the company. Only select this path if this is exactly what you want. Otherwise take some form of legal action.

I think the best lawsuit settlements are the ones that do not make you work in order to get the compensation. That means these are the ones that you do not have to fill out the claim form. You just get the money when everything has been settled. I remember my friend once got a check as a settlement for something. He had been aware of the settlement but did nothing. That gave him a check. I like that. It was not much as all of these cases are. The reason is because they have to spread the millions with millions of people. So whoever is eligible usually ends up getting a very tiny portion of the amount. He was grateful however to have gotten even that much. Every penny helps he said. In this day and age, I totally agree with him. I think that the company should be made to pay for their mistakes.
