Beebe Bradley Class Action Lawsuit Settlement – $100 Million
In the Beebe Bradley Class Action Lawsuit Settlement, Beebe Medical Center has agree to pay more than $100 million. The reason that the lawsuit was brought against the company is because the company hired a pedophile pediatrician. The former patients who filed the suit said that the hospital did not report the fact that it had hired a pedophile.
Right now there is no information on how the finances of the Beebe Bradley Class Action Lawsuit Settlement will be dealt with. If there is information on the settlement, it is being kept confidential and nobody knows this yet. It may take a long time before those affected in this case will get anything. It may be a year or more in fact. So if you are one of the patient affected, do not expect to receive a payment soon. The reason why it will take so long is to prevent Beebe from filing for bankruptcy. The other defendants in this case include the Medical Society of Delaware. Some Delaware doctors are also involved.
When the agreement is reached, how the money will be distributed will be made available to the public. Beebe’s lead attorney has said that non-financial matters still need to discussed and to be resolved. So there are still a number of things to be settled. There are hundreds of people who are involved in this class action settlement who will be waiting to get their compensation. Everyone who should be getting compensation have been notified.
Apparently the lawsuits were filed when it was discovered that Bradley was doing vaginal exams of the young patients. He also catheterized many of his patients. This was reported by a nurse and Bradley was investigated in 1996. Bradley moved to Delaware from Philadelphia. His move was due to accusations of him sexually abusing a child. He was cleared of the allegations but he moved to Delaware in 1995.
So the lawsuits state that Beebe did not report him to the Delaware medical disciplinary board. Bradley was accused of raping or abusing 86 of his young patients and he was convicted in August 2011. He videotaped all these incidents and he is now in jail serving 14 life sentences. The average age of his patients was 3 years old. Bradley is of course contesting the conviction. He says that the videos tapes were not taken legally.
This is actually a terrible case. Just the fact that a pedophile could get access to all the children he wanted and for him to be in a position to be able to examine them is just unimaginable to me. I would have thought that strict background checks would be performed on all those who work with children. I still do not understand how this happened or why it took so long for someone to finally figure out what was going on. How can the pediatrician even be allowed to be in the room alone with a child is mind boggling. For him to be able to videotape all this is even crazier. I just do not understand how this can happen.
Beebe has stated that the case has not been settled yet. However this is not really accurate as it has been announced in open court. It is the details that need to be worked out. When the agreement has been reached, Beebe will avoid bankruptcy. The children affected in this case will get trust funds. However these details have not yet been flushed out. It will be challenging to figure out how much damages should be allocated for each victim. This depends on the degree of abuse. The way that the damages will be distributed has to be approved by the court. So this will be a long and slow process as each will have to examined and evaluated separately for severity of abuse. It is said that some of the victims have been scarred while others have suffered only minor abuse. As a result there will not be equal distribution of funds.
I already see lawsuit and counter lawsuits based on this alone. I just wonder who will be making these decisions and how will the severity of the abuse be determined? That is the tough questions and a very tricky and challenging one. It will be interesting to follow this case to see how it unfolds.
