Hyundai Santa Fe Airbag Class Action Lawsuit Settlement

Hyundai is recalling 200,000 of the 2007-2009 Santa Fe crossovers because of the Hyundai Santa Fe Airbag Class Action Lawsuit Settlement. These vehicles are being recalled because of the airbag problem. The reason that the company is recalling them is to avoid the terms of the settlement.  The terms that they are trying to get away from is that they would have to buy the vehicles back from the customers if they cannot fix it. The lawsuit was actually filed in 2009.

The Santa Fe vehicles in the Hyundai Santa Fe Airbag Class Action Lawsuit Settlement have defective sensors that will turn the passenger air bag off when a small person sat in the front passenger seat who was less than 120 pounds. One set of  plaintiffs in the suit said that their daughter hit her head against the windshield in a crash because the air bag did not deploy. This happened even though she was wearing a seatbelt. Another set of plaintiffs said that the wife was less than 120 pounds in weight. The settlement will be filed in California by August 17, 2012. When this happens and you are eligible to get a refund for repairs, you will get a notice in the mail. This notice will tell you how to go about getting your benefits in this case.

It does not matter if this case is approved by the Judge or not. Either way, Hyundai will have to fix the malfunctioning airbags in the vehicles involved. Hyundai will have to fix the software glitch that caused this. With a functioning airbag, the sensors actually detect how bad the crash is and also takes into account the seating position of the passenger and also the size of the passenger. Based on this, the sensors then adjust the force of the air bag deployment. If a child is seated in the front passenger seat, then a warning light will come one. This warning light will say that the passenger air bag had been deactivated.

The complaint said that all Hyundai 2006-2009 models had the air bags with the problem sensors. However right now, only the Santa Fe vehicles are being recalled. It is unusual for the company to recall the vehicles before the settlement has been finalized. However in this case it is very understandable as they would still have to recall the vehicles anyway. Why wait till then? Also I think the company does not wish to buy back the vehicles that cannot be fixed.  I wonder what would have happened if that term was not in the settlement? What would the company do then? I doubt they would buy back the vehicles. It is more likely that they would pay the owners some kind of compensation. I think that would cost the company less than buying them all back.  I wonder what they would do with all the cars that they had bought that had the defective system. I guess they could just remove the sensors all together and get new ones?

So what do you have to do right now if you have a Hyundai Santa Fe of the models mentioned above and you would like to take part in the settlement? You will have to wait until you get a notice in the mail. If you have moved and do not think that you will get something in the mail then you should keep checking the website to see when the settlement information and website is up. When the site is up, you will be able to get all the information you need on how to get a refund.

I do not know what will happen if you decide to take your car in for repairs before the settlement has been approved. You may not be able to get any other compensation if you take your car in now. Also if your problem cannot be fixed, the company may not want to buy back your vehicle because you took it for repairs before the settlement was approved. So I would wait if I were you because you do not know what is going to happen. It is better to wait and have the company buy back your vehicle than to try to get it fixed now.
